Chapter 1 General Provisions

Article 1 In order to strengthen the management of Internet information content and promote the healthy and orderly development of Internet news information services, in accordance with the "Network Security Law of the People's Republic of China", "Internet Information Service Management Measures", and the State Council’s Authorization of the National Internet Information Office to be responsible for Internet information content management "Notice" to formulate these regulations.

Article 2 These regulations apply to the provision of Internet news information services within the territory of the People's Republic of China.

The news information mentioned in these regulations includes reports and comments on political, economic, military, diplomatic and other social and public affairs, as well as reports and comments on social emergencies.

Article 3. The provision of Internet news information services shall abide by the Constitution, laws and administrative regulations, adhere to the direction of serving the people and serving socialism, adhere to the correct guidance of public opinion, give play to the role of public opinion supervision, and promote the formation of a positive, healthy, upward and good network Culture, safeguard national interests and public interests.

Article 4 The National Internet Information Office is responsible for the supervision, management and law enforcement of Internet news information services nationwide. Local Internet Information Offices are responsible for the supervision, management, and law enforcement of Internet news information services in their respective administrative regions according to their duties.

Chapter II Licensing

Article 5 To provide Internet news information services to the public through Internet sites, applications, forums, blogs, microblogs, public accounts, instant messaging tools, webcasts, etc., shall obtain an Internet news information service license. Carry out Internet news information service activities beyond the permitted scope.

The Internet news information service mentioned in the preceding paragraph includes Internet news information collection, editing and publishing services, reprinting services, and dissemination platform services.

Article 6 To apply for an Internet news information service license, the following conditions shall be met:

(1) Legal persons established in accordance with the law within the territory of the People's Republic of China;

(2) The principal and editor-in-chief are Chinese citizens;

(3) Having full-time news editors, content reviewers and technical support personnel suitable for the service;

(4) Having a sound Internet news information service management system;

(5) Having a sound information security management system and safe and controllable technical safeguard measures;

(6) There are places, facilities and funds suitable for the service.

To apply for a license for Internet news information collection, editing and publishing services, it shall be a news unit (including its holding unit) or a unit in charge of the news and publicity department.

Eligible Internet news information service providers implement a special management unit system, and the specific implementation measures will be separately formulated by the State Internet Information Office.

To provide Internet news information services, the Internet information service license or filing procedures shall also be handled with the competent telecommunications department in accordance with the law.

Article 7 No organization may establish Internet news information service units operated by Chinese-foreign equity joint ventures, Chinese-foreign cooperative ventures, or foreign-funded enterprises.

Internet news information service units that cooperate with domestic and foreign Chinese-foreign joint ventures, Chinese-foreign cooperative ventures, and foreign-funded enterprises that involve Internet news information service businesses shall report to the State Internet Information Office for security assessment.

Article 8 The acquisition and editing business and operating business of Internet news information service providers shall be separated, and non-public capital shall not be involved in the Internet news information acquisition and editing business.

Article 9: For the application for Internet news information service license, the main body of the application is the central news unit (including its controlling unit) or the unit in charge of the central news and publicity department, the State Internet Information Office shall accept and decide; the main body of the application is the local news unit (including the unit) The Internet Information Office of the province, autonomous region, or municipality directly under the Central Government accepts and decides if the holding unit or a unit in charge of the local news and publicity department; if the subject of the application is another entity, after receiving and initial review by the Internet Information Office of the province, autonomous region, or municipality where it is located, Determined by the National Internet Information Office.

If the Internet Information Office of the state, province, autonomous region, or municipality decides to approve it, the Internet News Information Service License shall be issued. The "Internet News Information Service License" is valid for three years. If the period of validity expires and it is necessary to continue to engage in Internet news information service activities, it shall apply for renewal 30 days before the expiration of the period of validity.

The Internet Information Offices of provinces, autonomous regions, and municipalities directly under the Central Government shall regularly report to the State Internet Information Office the approval acceptance and decision.

Article 10 To apply for an Internet news information service license, the following materials shall be submitted:

(1) Proof that the principal responsible person and editor-in-chief are Chinese citizens;

(2) The qualifications of full-time news editors, content reviewers, and technical support personnel;

(3) Internet news information service management system;

(4) Information security management system and technical safeguard measures;

(5) Internet news information service security assessment report;

(6) Proof of legal person qualification, location, capital and equity structure, etc.;

(7) Other materials required by laws and regulations.

Chapter 3 Operation

Article 11 Internet news information service providers shall appoint a chief editor who is responsible for the content of Internet news information. The editor-in-chief candidate should have relevant working experience, meet relevant requirements, and report to the Internet Information Office of the state or province, autonomous region, or municipality directly under the Central Government for the record.

Practitioners related to Internet news information services shall obtain corresponding qualifications and receive professional training and assessment in accordance with the law. Practitioners related to Internet news information services engaged in news gathering and editing activities shall have the professional qualifications of news gathering and editing personnel and hold a journalist card issued by the State Administration of Press, Publication, Radio, Film and Television.

Article 12 Internet news information service providers shall complete information security management systems such as information release review, public information inspections, emergency response, etc., and have safe and controllable technical guarantee measures.

Article 13: Internet news information service providers who provide users with Internet news information dissemination platform services shall require users to provide true identity information in accordance with the provisions of the "Network Security Law of the People's Republic of China". If users do not provide real identity information, Internet news information service providers shall not provide relevant services for them.

Internet news information service providers are obliged to keep the user's identity information and log information confidential, and must not leak, tamper with, or damage them, and must not sell or illegally provide them to others.

Internet news information service providers and their practitioners must not seek illegitimate benefits by compiling, publishing, reprinting, deleting news information, or interfering in the presentation of news information or search results.

Article 14 Internet news information service providers providing Internet news information dissemination platform services shall sign agreements with users registered on their platforms to clarify the rights and obligations of both parties.

For users who open public accounts, Internet news information service providers shall review their account information, service qualifications, service scope, and other information, and report to the Internet Information Office of the province, autonomous region, or municipality where they are located.

Article 15: When Internet news information service providers reprint news information, they shall reprint news information released by central news units or news units directly under the central government, such as news units directly under the central government, and other units within the scope of national regulations, indicating the source, original author, and original source of the news information. Titles, real names of editors, etc., shall not distort or tamper with the original meaning of the title and the content of the news information, and ensure that the source of the news information can be traced.

Internet news information service providers who reprint news information shall abide by the provisions of relevant copyright laws and regulations, and protect the legitimate rights and interests of copyright owners.

Article 16 Internet news information service providers and users shall not produce, copy, publish, or disseminate information content prohibited by laws and administrative regulations.

When Internet news information service providers discover content that violates Article 3 of these regulations or the preceding paragraph in the course of providing services, they shall immediately stop transmitting the information according to law, take measures such as elimination, save relevant records, and report to relevant competent authorities.

Article 17 When an Internet news information service provider changes the main person in charge, editor-in-chief, competent unit, equity structure and other major matters that affect the licensing conditions, it shall go through the modification procedures with the original licensing authority.

Internet news information service providers applying new technologies, adjusting and adding application functions with news public opinion attributes or social mobilization capabilities should report to the Internet Information Office of the state or province, autonomous region, or municipality directly under the Central Government for an Internet news information service security assessment.

Article 18 Internet news information service providers shall clearly indicate the Internet news information service license number in an obvious place.

Internet news information service providers shall consciously accept social supervision, establish channels for social complaints and reports, set up convenient complaints and reports portals, and handle public complaints and reports in a timely manner.

Chapter IV Supervision and Inspection

Article 19 The State and local Internet Information Offices shall establish a supervision and management system that combines daily inspections and regular inspections to implement supervision and inspection of Internet news information service activities in accordance with the law, and relevant entities and individuals shall cooperate.

National and local Internet Information Offices should improve the qualification management system for law enforcement personnel. When carrying out law enforcement activities, law enforcement personnel shall produce law enforcement credentials in accordance with the law.

Article 20 Any organization or individual who discovers that Internet news information service providers have violated these regulations may report to the national and local Internet information offices.

The national and local Internet Information Offices shall disclose the report acceptance method to the public, and shall deal with the report according to law after receiving the report. Internet news information service providers should cooperate.

Article 21 The State and local Internet Information Offices shall establish Internet news information service network credit files, establish a blacklist system for dishonesty and an interview system.

The National Internet Information Office has established an information sharing mechanism with the State Council’s telecommunications, public security, press, publication, radio, and television departments to strengthen work communication and collaboration, and carry out special supervision and inspection activities such as joint law enforcement in accordance with the law.

Chapter V Legal Responsibilities

Article 22. In violation of Article 5 of these regulations, those who carry out Internet news information service activities without permission or beyond the scope of permission shall be ordered by the Internet Information Office of the state, province, autonomous region, and municipality directly under the Central Government to stop related service activities and impose a penalty of 10,000 yuan. A fine of more than RMB 30,000 and less than RMB 30,000.

Article 23: If an Internet news information service provider no longer meets the licensing conditions during its operation, the original licensing authority shall order it to make corrections within a time limit; if it still does not meet the licensing conditions after the expiry date, the news information update shall be suspended; "Internet News Information Service License" If the license conditions are not met after the expiration of the validity period, the license shall not be renewed.

Article 24. Internet news information service providers violate Article 7, paragraph 2, Article 8, Article 11, Article 12, Article 13, paragraph 3, Article 14, and 10. According to the provisions of Article 5, Article 17, and Article 18, the national and local Internet Information Offices shall give warnings based on their duties and order corrections within a time limit; if the circumstances are serious or if corrections are refused, the news information update shall be suspended and a penalty of 5,000 yuan shall be imposed. A fine of not less than RMB 30,000 but not more than RMB 30,000; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law.

Article 25. If Internet news information service providers violate the provisions of Article 3, Article 16, paragraph 1, Article 19, paragraph 1, and Article 20, paragraph 2 of these regulations, the national and local Internet information The office gave warnings based on their duties and ordered corrections within a time limit; if the circumstances were serious or refused to make corrections, the news information update was suspended, and a fine of 20,000 yuan to 30,000 yuan was imposed; if a crime was constituted, criminal responsibility was pursued in accordance with the law.

Article 26. If Internet news information service providers violate the provisions of Article 13 Paragraph 1 and Article 16 Paragraph 2 of these regulations, the national and local Internet Information Offices shall comply with the provisions of the "Network Security Law of the People's Republic of China" Be dealt with.

Chapter VI Supplementary Provisions

Article 27 The "news unit" mentioned in these regulations refers to newspapers and periodicals, radio stations, television stations, news agencies and news film studios established in accordance with the law.

Article 28 Anyone who violates these regulations and at the same time violates Internet information service management regulations shall be dealt with by the national and local Internet information offices in accordance with these regulations and transferred to the competent telecommunications department for disposal in accordance with the law.

If the state has other regulations on Internet audio-visual program services, online publishing services, etc., these regulations shall be met at the same time.

Article 29 These regulations shall come into force on June 1, 2017. If the relevant regulations promulgated before the implementation of these regulations are inconsistent with these regulations, they shall be implemented in accordance with these regulations.
